General terms and conditions of Wyden Micro Systems GmbH for the rental of a holiday apartment
1. Registration:
By making your reservation and/or rental agreement, you enter into a binding accommodation contract. By making a payment (or partial payment) for your booking, you expressly agree to these terms and conditions.
The right to correct obvious errors, e.g. printing and calculation errors, remains reserved.
Special requests, bookings subject to conditions and verbal side agreements are only valid if they are confirmed by us in writing.
2. Payment terms:
50% of the total rental price, including additional services and a security deposit, is due three days after booking confirmation. The remaining payment must be made no later than 30 days before the start of the rental period.
Payment is made via bank transfer or online bank transfer using a SWIFT or IBAN code, saving you the high costs of international transfers. All bank charges are borne by the customer.
3. Special conditions / notes:
Extra beds, cots, and high chairs are available in some rooms. These must be requested in advance and noted at the time of booking.
Non-smoking apartment: Smoking is prohibited in the apartments. Failure to comply with this ban will result in the landlord demanding compensation and additional cleaning costs of CHF 500.
Keeping pets (including dogs, cats, birds, reptiles, rats, ferrets, guinea pigs, hamsters, etc.) is not permitted.
Arrival: Unless otherwise stated, from 4:00 PM. Complaints regarding the apartment (cleanliness, defects, etc.) will only be considered until 6:00 PM on the day of arrival.
The tenant has the right to use the rental property, including its inventory and utensils. Nails may not be hammered into walls, ceilings, windows, furniture, etc. The tenant is responsible for everything belonging to the rental property. The tenant is obligated to report any defects or damage that occur during the rental period immediately. Upon departure, the tenant must return the property, including all accessories, in the same condition as it was found upon arrival. This means that all furnishings must be in the same place, the refrigerator and cupboards emptied, and dishes and pots cleaned of food residue. The tenant is liable for any damage caused to the rental property and its inventory by themselves and their accompanying persons. The tenant is responsible for proving that the damage was not at fault. The rental property may not accommodate more people than stated in the booking agreement. The number of people stated in the booking also includes (small) children, unless otherwise agreed with us. In the event of overcrowding, the landlord reserves the right to refuse entry to any excess persons or to charge additional fees.
Departure day: The rental property must be vacated by 9:00 a.m. at the latest and left in a tidy and clean condition. Keys must be left on the kitchen table. Beds must be stripped, all waste must be disposed of at the garbage collection point, and all dishes must be washed and stored in the cupboards. Apartments left in an unacceptable condition or where the above-mentioned points are not met will be subject to an additional cleaning fee of at least CHF 200.
Waste that must be disposed of by the landlord will be charged at least CHF 100.
4. Withdrawal / Cancellation Conditions:
If the tenant is unable to take the agreed vacation, they must notify the landlord as early as possible. However, they remain liable for the rent as follows:
Up to 61 days before the start of the rental period with 50% of the total price
60 to 31 days before the start of the rental period with 80% of the total price
Thereafter 100% of the total price
If the agreed rental period is not fully adhered to, the full rental fee for the agreed period must still be paid. In the event of later cancellation or failure to start the trip, the full rental price will be charged.
Changes to dates are considered cancellations and re-registrations. If we withdraw from the contract before the start of the trip (due to force majeure such as war, strikes, pandemics, damage to the rental property due to accidents, fire, water damage, or similar compelling reasons such as double bookings), all amounts paid will be refunded immediately; further claims are expressly excluded.
If we terminate the rental agreement after the start of your stay, you will only be charged the rent plus additional costs accrued up to that point; the remainder will be refunded.
5. Insurance:
We recommend taking out travel cancellation insurance. The landlord assumes no liability towards the tenant.
6. Privacy Policy:
The personal data you provide to us when booking will be used exclusively for the purpose of the booking and will only be passed on to third parties to fulfill the obligations arising from the rental agreement (e.g. tourist tax or registration for a guest card).
7. Liability:
No liability can be accepted for service disruptions caused by events beyond our control, particularly in the event of war, strikes, natural disasters, pandemics, etc., as well as for service disruptions in the areas of transport, supply and disposal (e.g. water, energy, access roads, internet access, etc.), particularly if these disruptions are caused by force majeure or local climatic conditions.
8. General:
Otherwise, the provisions of the Swiss Code of Obligations apply. The place of jurisdiction is Fribourg. These terms and conditions are an integral part of the rental agreement, which is deemed legally binding upon payment of the deposit.
